Does UAE law or my home country's law apply to my divorce?

Either can. Non Muslim expatriates may apply the law of their home country to divorce and to the division of assets, and there is a separate civil personal status regime in the UAE. Which serves you depends on where your assets sit and what your marriage looks like on paper. It is the single most consequential decision in an expatriate divorce and it should be taken deliberately, not by default.

My spouse owns the property. Do I have any claim?

Often, yes. Title is one factor. Contributions, the source of the funds and the applicable law all bear on it. Assets a client had been told were beyond reach have been brought into the estate once the paper trail was assembled.

Can my spouse stop me leaving the country with my children?

Travel restrictions on children can be applied for and they are granted. They can also be challenged and lifted. If this is a live risk in your matter, raise it in the first conversation rather than later.

Is the first consultation paid?

Yes. We confirm the consultation fee before you book. If you instruct HK Legal to handle your matter, that fee is deducted from your legal fee.

Can I pay legal fees in instalments?
